Bryan Cave Presents In-House Counsel CLE Institute

On Friday, February 24, 2012, Bryan Cave will host the 2012 In-House Counsel CLE Institute, a complimentary CLE seminar, in its Atlanta office.  Recognizing the many diverse topics corporate counsel confront on a daily basis, Bryan Cave attorneys will provide guidance on the following issues:

We anticipate the seminar will be approved for 6.5 hours of CLE credit, including 1.0 hour of Ethics credit and 1.0 hour of Professionalism credit. Breakfast and lunch will be provided, and a reception will conclude the seminar. Breakfast/registration is scheduled to begin at 8:00am on Friday, with the seminar running from 8:30am until 4:30pm.

Statutes of Limitation and Arbitration

We’ve previously discussed arbitration agreements in a number of contexts, including who should sign them and when courts have enforced them.  While whether to include an arbitration clause in your standard account agreement is a business decision (and you will find people with very strong opinions on both sides of this debate), if you decide to include one you better make sure that your boilerplate is up-to-date.  Especially in Florida and especially as it relates to statutes of limitation. Filing An Answer Required In Indiana Will Contest Actions

In Avery v. Avery, the Indiana Supreme Court resolved what had apparently been an open question under Indiana law when it ruled that filing of an answer as required by Indiana Trial Rule 7 is required in a will contest action. (more…)

Texas Jury Finds That Husband Unduly Influenced Wife

Last week, in In re Ward, the Tenth Court of Appeals of Texas (Waco) affirmed a jury verdict that the will of Doris Ward was unenforceable because her husband, Bobby Ward, exerted undue influence over her.  So, what does a textbook case of undue influence look like?  Well, it usually starts with remarriage.  (more…)

Fiduciary Litigator’s Overzealous Representation Leads to Sanctions

Litigators can often have a hard time backing down from the zealous representation of their clients.  This is particularly true when someone of diminished capacity is exploited and when still others are aware of the exploitation and either let it happen or facilitate it.  A fiduciary litigator in Iowa recently learned the hard way that, while it might be okay to sue based on suspicions, as soon as you learn that the facts don’t back up your suspicions, you better dismiss the lawsuit.
